By accessing this School, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

2. Use License

  1. Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
      1. modify or copy the materials;
      2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
      3. attempt to decompile or reverse engineer any software contained on the School’s web site;
      4. remove any copyright or other proprietary notations from the materials; or

4. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. The School does not warrant that any of the materials on its web site are accurate, complete, or current. Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction without regard to its conflict of law provisions.

TERMS AND CONDITIONS

The Fast Metabolism Diet Coaching Level 1 Participant Agreement

In consideration of the opportunity to participate in a Fast Metabolism Diet™ Coaching – Level 1 Class (the “Class”) presented by the Haylie Pomroy Group, Inc. (“HPG”), I (the “Participant”) hereby affirm, acknowledge, and agree as follows:

  1. Participant has the independent knowledge, expertise, and experience necessary to apply the concepts to be presented in the Class in his/her own coaching practice with groups and/or individuals.
  2. Upon completion of the Class, Participant may receive a certificate indicating his/her attendance at the Class.
  3. I understand that Class, information and materials including handout and/or downloaded notes, lectures, PowerPoint presentations, demonstrations, computer videos, and online presentations produced by HPG are the copyrighted property of HPG and are for my personal education and training only and may not be reproduced, copied or retransmitted by me for any purpose without the express written consent of HPG.
  4. In addition to the FMD Certification, Participant may receive a limited license to use certain trademarks owned by HPG (the “Marks”) in connection with Participant’s coaching practice. The terms and conditions of such limited license may be provided to Participant upon the completion of the class and the receipt of the FMD Certification and any use of the Marks prior thereto is strictly prohibited.
  5. Participant is strictly prohibited from holding him/herself out as a “certified” Fast Metabolism Diet coach at any time before, or during the class. In the event that Participant receives an FMD Certification upon completion of the class Participant may hold him/herself as being a Certified Fast Metabolism Diet Coach.
  6. Participant shall not audio or video record any portion of the Class, for any purpose, without the advanced written consent of HPG.
  7. HPG SPECIFICALLY DISCLAIMS TO THE EXTENT PERMITTED BY APPLICABLE LAW ANY AND ALL WARRANTIES RELATING TO THE CLASS AND ALL MATERIALS PROVIDED AT THE CLASS, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY.
  8. Participant shall indemnify, defend and hold HPG, its principals, officers, agents, employees, affiliates and assigns, harmless from and against any and all third-party claims arising out of or relating to Participant’s attendance at the CLASS, including, but not limited to, Participant’s subsequent application or misapplication of any concepts presented at the CLASS.
  9. Participant shall have no right or authority to act for or bind HPG in any way or to sign the name of HPG, or to represent that HPG is in any way responsible or liable for the acts, written or verbal statements or admissions of Participant. Participants shall not have the right to use Haylie's Name, logo, or likeness at any time before, during, or after course completion, without the expressed written consent of HPG.
  10. During the CLASS Participant may have access to certain confidential and proprietary information belonging to HPG. Confidential and proprietary information includes, but is not limited to, scientific formulas and other information relating to the science behind the Fast Metabolism Diet, marketing information, operations and other HPG information not otherwise available to the general public. Participant agrees to keep all confidential and proprietary information confidential, and will not: i) use such confidential and proprietary information for any purpose other than coaching groups or individuals in the Fast Metabolism Diet; or ii) disclose such information by any means to any third party, except as required to perform the permitted coaching services.
  11. In further consideration of the opportunity to participate in the CLASS, Participant agrees that the CLASS may be videotaped or audiotaped by HPG, and such video or audio may be broadcast and distributed by HPG without limitation through any means and Participant shall not receive any compensation for his/her participation. Participant specifically agrees to the use of his/her likeness, portrait or pictures, voice and non-identifying biographical information by HPG and understands that Participant shall not be compensated in any way for such use by HPG.

By completing the registration for the Class, the Participant agrees to be bound by this Agreement. If you do not agree to be bound by each and every term of this Agreement, do not complete the Registration process.
